Azer Logistics provides freight transportation, last-mile delivery, warehousing, and related logistics services. The specific terms of service for each shipment or storage arrangement will be detailed in individual service agreements or shipping documents.
3. User Obligations
When using our services, you agree to:
- Provide accurate and complete information about shipments
- Comply with all applicable laws and regulations
- Properly package and label all shipments
- Not ship prohibited or restricted items without proper authorization
- Pay all fees and charges in a timely manner
- Maintain insurance for valuable shipments as appropriate
4. Prohibited Items
The following items are prohibited from shipment unless specifically authorized:
- Hazardous materials and dangerous goods (without proper documentation)
- Illegal substances and contraband
- Perishable goods (without special arrangements)
- Live animals (except where specifically authorized)
- Items prohibited by law or regulation
- Currency, precious metals, or valuable securities (without special handling)
5. Pricing and Payment
Prices for our services are provided in quotes and invoices. Payment terms will be specified in individual service agreements. We reserve the right to:
- Adjust prices based on fuel costs, distance, weight, and other factors
- Charge additional fees for special handling or services
- Suspend services for non-payment
- Charge interest on overdue accounts
6. Liability and Insurance
6.1 Our Liability
Our liability for loss or damage to shipments is limited to:
- The actual value of the goods, up to the declared value
- Maximum liability limits as specified in individual service agreements
- We are not liable for indirect, consequential, or special damages
6.2 Claims Process
Claims for loss or damage must be:
- Reported in writing within 7 days of delivery or scheduled delivery date
- Accompanied by proof of value and supporting documentation
- Filed using our official claims form
6.3 Insurance
We strongly recommend that customers obtain insurance for valuable shipments. Additional insurance coverage may be available for purchase.
7. Delivery Terms
Delivery times are estimates and not guaranteed unless specifically agreed in writing. We are not liable for delays caused by:
- Weather conditions or natural disasters
- Traffic conditions or road closures
- Customs delays or inspections
- Incorrect or incomplete delivery information
- Force majeure events beyond our control
8. Warehousing Terms
For warehousing services:
- Storage fees are charged based on space used and duration
- We reserve the right to relocate stored goods within our facility
- Access to stored goods may require advance notice
- Unclaimed goods may be disposed of after 90 days notice
- We maintain insurance on our facility but recommend customer insurance for stored goods
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Azer Logistics and protected by intellectual property laws. You may not use, reproduce, or distribute our content without written permission.
10. Limitation of Liability
To the maximum extent permitted by law, Azer Logistics shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages exceeding the fees paid for the specific service
11. Indemnification
You agree to indemnify and hold harmless Azer Logistics from any claims, damages, or expenses arising from:
- Your breach of these Terms and Conditions
- Your shipment of prohibited or improperly packaged items
- Your violation of any laws or regulations
- Third-party claims related to your shipments
12. Dispute Resolution
Any disputes arising from these Terms and Conditions or our services shall be:
- First attempted to be resolved through good-faith negotiation
- If unresolved, submitted to mediation
- Governed by the laws of Azerbaijan
- Subject to the exclusive jurisdiction of courts in Gabala, Azerbaijan
13. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or other force majeure events.
14. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
15. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Azer Logistics regarding our services.
